These general conditions of sale govern the relations between “Breiz Shopping” and users of the site “ https://breizh-shopping.com ”.

The site https://breizh-shopping.com , dedicated to the online store, is the full property of Stéphane CARREY, self-employed, with his head office at 10 Le Clos Tumiac 56640 ARZON, as well as all rights relating thereto. .

Products and services

All articles and products in the online store are illustrated by a representative photo of the article or product you will receive. However, it is important to take into account that the photos representing the items and products or in the store catalog are not contractual and can in no way engage the liability of "Breizh Shopping" towards the customer.

Each of the articles and products present on the website includes the name, description, packaging and quantity of the latter. In the event of unavailability of the item or products ordered by the customer, beyond our control (stock computer error, damaged product), the customer will be immediately informed by e-mail or by telephone.

In this case, the customer will have the following options:

  1. A refund for the missing product (if ordering several products);
  2. Cancellation and full refund of the order, including delivery costs;
  3. Sending the missing product upon receipt by our producer, with the entire order (in the event of ordering several products). Additional delivery costs will be borne by "Breizh Boutique";
  4. An exchange of the missing product for another product of equivalent value.

In the event of a stock shortage of one or more products making up a filled basket or gift box. Breizh Shopping may modify its content and replace one or more out-of-stock items with equivalent products or a higher amount. Replacement of the product(s) will be indicated on the product sheet.

Orders

By placing an order, the customer acknowledges having read and accepted these general conditions of sale. Once the order has been validated, a confirmation email will be sent to the buyer, containing the following information: product description, quantity, price and delivery terms.

Before confirming the order, "Breizh Shopping" reserves the right to verify the identity, address and bank details of the Internet user. In the event of a dispute relating to payment, "Breizh Shopping" reserves the right to cancel the order.

Product prices

The sales prices of the products are mentioned in euros, excluding tax (“VAT not applicable according to article 293-B of the General Tax Code) and excluding delivery costs. The amount of delivery costs will be specified to the customer on the order form before validation.

The price indicated when ordering is firm and final for the buyer. However, "Breizh Shopping" reserves the right to modify prices at any time. In this case, the price agreed when placing the order will remain applicable and will be invoiced, even in the event of a subsequent price change.

Special case of orders outside the European community

For any order destined for a country located outside French territory, the customer will be considered the importer of the products. In the case of deliveries outside the European Union and overseas departments, the price invoiced will be calculated excluding taxes.

Therefore, customs duties and local taxes will be entirely the responsibility of the customer. The customer is therefore recommended to check with local authorities to find out the taxes and customs fees applicable in the country of import.

These rights and other costs are in no way the responsibility of “Breizh Shopping”. Additionally, please note that certain products may be subject to import limitations depending on the country. It is advisable to check with local authorities for information on this subject.

It is also necessary to consider restrictions on shipping alcoholic beverages and certain goods to other countries. For example, alcohol shipments to the United States, Great Britain, Ireland, Canada, the Canary Islands, all Muslim countries, Sweden, Argentina, Brazil, Norway, New -Zealand and Russia are prohibited.

This list is not exhaustive. Sending a package containing prohibited goods exposes the customer to various risks. The package may be blocked, refused, destroyed or result in additional costs payable by the customer.

In addition, if the package is blocked, the customer will have to pay additional costs to recover it, without the possibility of reimbursement of shipping costs already incurred.

In the event of a dispute, no claim will be admissible and the customer will not be able to claim any compensation.

Payment terms

Payment for the order placed with “Breizh Shopping” must be made in full on the day of the order. The website accepts the following payment methods:

  • PayPal payment

In the event of non-payment or payment incident, "Breizh SHopping" reserves the right to cancel the customer's order.

Payment by credit card is made via a secure and encrypted system.

For payments via PayPal, you are invited to log in with your PayPal credentials and follow the instructions to validate your payment.

Delivery

For any delivery in mainland France, the products ordered will be sent to the delivery address or relay point indicated by the customer, via services such as Colissimo, Mondial Relay, Chronopost or any other carrier. Unless otherwise indicated, packages are shipped the day following validation of the order on the website.

It is essential to note that orders placed between Friday 12:00 p.m. and Sunday evening will only be shipped from Monday morning.

The delivery time estimated by "Breizh Shopping" is as follows:

  • Home delivery: 48 to 72 hours with Colissimo, 2 to 5 working days with tracked letters, 24 hours with Chronopost, and 24 to 48 hours with UPS;
  • Delivery to relay point: 3 to 5 days with Mondial Relay.

Please note that the delivery times mentioned above are given for information purposes only. Parcels are entrusted to private transport companies such as La Poste, UPS or Chronopost, which are responsible for these delays.

No claim for compensation from “Breizh Shopping” will be possible in the event of reasonable delay. Additionally, please note that these times are not guaranteed for Corsica due to transit and may require several additional days.

On average, delivery time in mainland France is 5 working days. "Beizh Shopping" cannot be held responsible for any delays linked to malfunctions of postal services, road carriers, transport strikes, unfavorable weather conditions (snow, ice, etc.) or natural disasters or situations. exceptional.

Delivery may be delayed and the deadlines announced above may therefore be extended. In the event of such events, "Breizh Shopping" declines all liability and the customer will not be able to claim any compensation.

For deliveries within the European Union and Switzerland, the delivery time is generally 2 to 4 working days. For other countries and overseas departments, lead times vary from 3 to 15 working days, depending on customs clearance formalities which may affect initial lead times.

Shipments to countries outside the European Union are made tax free. Taxes may be required upon arrival of the package upon collection. These costs cannot be reimbursed by “Breizh Shopping”.

Withdrawal and Complaint

The buyer has a right of withdrawal for a period of 14 days from receipt or collection of the package, without having to provide reasons or pay penalties. If the buyer wishes to exercise his right of withdrawal, he must inform “Breizh Shopping”.

The return of the products will be made at the customer's expense by post, in their original condition and complete, accompanied by a copy of the purchase invoice, to the following address: Stéphane CARREY 10 Le Clos Tumiac 56640 ARZON. “Breizh Shopping” will reimburse you within a maximum of 15 days.

It is important to note that returns of products opened or with damaged packaging will not be accepted. Likewise, cosmetic products, perfumes and food products likely to deteriorate or expire quickly will be refused by "Breizh Shopping" (in accordance with article L121-28 of the consumer code).

In the case of textile products, these must not have been worn, except when trying on. Products must be returned in perfect condition. Any return showing visible traces of use or damage (perfumes, stains, missing labels on clothing, etc.) will be refused for the products concerned.

Please note : The right of withdrawal does not apply to orders placed by professionals, communities or associations.

In the event of a complaint or problem related to the order or products, we encourage you to contact the website's customer service.

Package return

If the address indicated by the customer when ordering is incorrect, or if the customer has not collected his package made available in the post office indicated on the delivery notice, within 7 days, or at the relay point (Mondial Relay or UPS) within 7 days, the package will be returned to “Breizh Shopping” by the carrier.

In this case, "Breizh Shopping" undertakes to promptly notify the customer by e-mail or telephone (depending on the information communicated when ordering). The customer will then have the choice between rescheduling a second shipment at their expense, at a relay point or at home in mainland France, according to the transport rates indicated on the store, or canceling the order.

In the event of cancellation of the order, the products will be refunded, but shipping costs will remain the responsibility of the customer.

In case of lost package

If the customer has never received the package and it has been lost by La Poste or the carrier selected when ordering, "Breizh Shopping", after investigating and noting the loss of the package, will send it again to his load. The Internet user must certify on their honor that they have never received the package and refuse the first shipment if they were to receive it later.

This certificate will allow “Breizh Shopping” to take appropriate measures.

Defective or damaged packages

In the event of a package damaged during delivery, he must immediately refuse the package to the carrier. If the customer notices an anomaly upon receipt of his order and the products ordered are damaged or broken, he must contact "Breizh Shopping" as quickly as possible within a maximum period of 48 hours and send one or more photos for verification of the products damaged. After verification and observation of the damage by "Breizh Shopping", the latter undertakes to reimburse or exchange the products concerned.

Error while preparing the order

“Breizh Shopping” takes all necessary measures to ensure proper preparation of customers’ orders. However, if the customer notices the slightest reference error in his order, he must contact “Breizh Shopping” to replace the product. The costs of returning the product that does not conform to the customer's order will be covered by "Breizh Shopping", as well as the product normally ordered. It is also possible to request a refund instead of reshipment.

The civil or criminal liability of "Breizh Shopping" is not incurred for any improper use of the products sold or for damage for which the supplier of the product is responsible.

“All publications on the website concerning products or otherwise may be withdrawn or modified by “Breizh Shopping”.

* Discount and Promotion

Discounts are only valid for the duration of the applicable offer and limited to certain references and stocks. They cannot be converted into money and are not transferable. With some exceptions, they cannot be combined. If the Customer enters several Discounts, he can only benefit from the one with the largest amount.

The product promotions offered are visible in the announcement bar at the top of the home page of our store. To benefit from it, simply reach the order amount indicated in euros, excluding shipping costs.

Breizh Shopping reserves any modification to the product or the duration of the promotion. Items are offered while stocks last at the time of the promotion.

If the promotional item is no longer available, Breizh Shopping may offer another product as a replacement.

Law and litigation

These General Conditions of Sale are subject to French law, in particular articles L.121-16 to L.121-20 of the Consumer Code. In the event of a dispute, the buyer must first contact the seller in order to agree on an amicable solution. If no agreement is reached, disputes will be submitted to the jurisdiction of the court at the head office of "Breizh Shopping".

Intellectual property

All elements (visual, audio, textual, etc.) present on the “Breizh Shopping” site remain the exclusive property of “Breizh Shopping”. No reproduction, exploitation, distribution or use may be made without the prior authorization of “Breizh Shopping”.
